Terms of Service

1. Who we are

Aviato Studio is operated by RivTech (SASU), 66 avenue des Champs-Élysées, 75008 Paris, France (RCS Paris 878 511 336). “We”, “us”, and “RivTech” refer to this company; “you” refers to the customer.

2. The Service

Aviato Studio is a cloud platform for running computational fluid dynamics (CFD) simulations on on-demand GPUs, with browser-based pre- and post-processing. We may improve, change, or discontinue features over time.

3. Accounts & eligibility

The Service is intended for businesses and professional users aged 18 or over. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.

4. Plans & billing

• Demo — a free, guided session; no payment required.
• Pro — usage-based pricing, billed by the GPU-minute at a rate that depends on the GPU tier you select, plus storage. You can set budget caps to limit spend.
• Enterprise — custom terms set out in a separate order form or agreement.

Fees, payment method, and billing cycle are presented before you incur charges and/or in your order form. Unless stated otherwise, fees are exclusive of VAT and other applicable taxes, which you are responsible for. Estimates shown in the product or on our website are indicative, not binding quotes.

Note: self-serve payment processing is being finalised. Until then, paid usage is arranged directly with us; the applicable payment processor and its terms will be disclosed at sign-up.

5. Acceptable use

You agree not to:

• use the Service unlawfully or to infringe others’ rights;
• attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service or its infrastructure;
• resell or provide the Service to third parties except as permitted in writing;
• upload content you have no right to process, or that violates export controls or sanctions.

6. Your data & intellectual property

You retain all ownership of the geometry, meshes, configurations, and results you upload or generate (“Customer Data”). You grant us a limited licence to host and process Customer Data solely to provide the Service. We and our licensors retain all rights in the Aviato Studio platform, software, and brand. Processing of personal data is governed by our Privacy Policy and DPA.

7. Availability & warranties

The Service is provided “as is” and “as available”. Except as expressly stated in an Enterprise agreement, we make no warranty of uninterrupted or error-free operation, and we do not warrant that simulation results are fit for any particular engineering decision — you are responsible for validating results for your use case.

8. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss (including lost profits, data, or business). Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot be excluded under French law.

9. Suspension & termination

You may stop using the Service and close your account at any time. We may suspend or terminate access for breach of these terms, non-payment, or to comply with law. On termination, Customer Data is deleted in line with our Privacy Policy (within 30 days of account closure), subject to legal retention obligations.

10. Confidentiality

Each party will protect the other’s non-public information disclosed in connection with the Service and use it only to perform under these terms.

11. Changes to these terms

We may update these terms; material changes will be posted here and, for active customers, notified by email where appropriate. Continued use after changes take effect constitutes acceptance.

12. Governing law & jurisdiction

These terms are governed by French law. Any dispute that cannot be resolved amicably will be submitted to the Tribunal de commerce de Toulouse. Where you contract as a consumer, mandatory provisions of your country of residence and competent consumer courts may also apply.
